Conservation rooflights

Do I need permission for a rooflight in a conservation area?

Usually on a slope facing a highway. Often not on a rear slope. Article 4 changes everything.

Permitted development rights still exist in a conservation area but they are narrower, and the answer depends mostly on which slope.

The general position

A slope facing a highway: usually requires permission.

A rear slope not visible from the public realm: often does not.

That is a rule of thumb. The local authority is entitled to take a different view on a particular street, and in a tightly enclosed historic centre a rear slope may still be visible from somewhere that matters.

Article 4 directions

Where one applies, permitted development rights may be removed entirely for the elevations it covers. That turns a job needing nothing into a job needing an application.

Article 4 coverage is not visible from the property and it is checked rather than assumed. We check before quoting.

The 150mm rule still applies

Even where permitted development survives, a rooflight generally must not project more than 150mm above the existing roof plane. A flush conservation unit clears this comfortably, which is one reason it is the product officers expect.

What gets agreed

On a visible slope, a flush conservation rooflight in black with a single central bar. A standard roof window standing proud of the tiles will generally be refused.

Smaller and fewer is easier than larger and more.

Building Regulations are separate

A job can need planning permission, Building Regulations approval, both or neither. A new opening is notifiable under Building Regulations regardless of the planning position, and we handle that notification.

Locally

Colchester’s conservation area covers the historic core and the Dutch Quarter, with further designation through the villages. Full detail on the conservation page.

This is the single most misunderstood point in this whole subject, so it is worth being precise.

Being in a conservation area does not by itself remove permitted development rights for rooflights on a house. On an unlisted house in a conservation area with no direction in place, a rooflight is permitted development on the ordinary terms: no more than 150mm beyond the plane of the roof, and not above the highest part of it.

What does remove them

An Article 4 direction. This is a formal step taken by the local planning authority to withdraw specified permitted development rights within a defined area, and it is common in conservation areas of quality.

Directions vary. Some cover all elevations, some only those fronting a highway or a public space, and some cover particular streets rather than the whole designation.

Whether one applies to your address is a matter of checking with the council rather than a judgement call, and the answer genuinely varies street by street.

The other exceptions

Listed buildings. Consent required regardless, on any slope, visible or not. A great many buildings in conservation areas are also listed, and the listing is what bites.

Flats and maisonettes. No permitted development rights at all, anywhere.

Converted buildings. Frequently granted with permitted development rights removed by condition, and those run with the property.

Where an application is needed

The design that gets through is a conservation rooflight: sitting low against the plane of the covering, upright rather than wide in proportion, with a central glazing bar, in matt black. The profile matters more than the other three combined.

Include the manufacturer’s section drawing showing how far the unit stands above the covering, because that is the question the officer actually needs answered.

Describe honestly what is visible from where. A rear slope screened by the ridge from every public vantage point is a much easier case than the same unit at the front, and saying so plainly helps.

Where it is not

On a rear slope of an unlisted house in a conservation area with no direction, you may not need an application at all, and you may not need a conservation unit either.

That is worth establishing before paying for a specialist product, and we check it as part of quoting rather than defaulting to the expensive answer.

The two enquiries worth making

Search the national heritage list for your address, which establishes whether the building is listed. That is a matter of record and it takes a minute.

Then ask the local planning authority whether the property is in a conservation area and whether an Article 4 direction applies to it. That is a short enquiry and it is the answer that actually decides whether you need an application.

Both are free. Both are considerably cheaper than finding out afterwards, because a rooflight installed without a consent it needed is an enforcement matter that attaches to the property and surfaces on sale.

We do both checks as part of quoting rather than asking you to, and where a standard unit would be consented on a rear slope we say so rather than defaulting to a conservation product.

What conservation area designation changes

It restricts permitted development rights rather than removing them wholesale.

The significant restriction for rooflights is on the principal elevation, or a side elevation fronting a highway. Those lose permitted development status in a conservation area, which means a rooflight there needs planning permission.

A rear slope not visible from the public realm frequently retains permitted development, subject to the usual conditions on projection and height.

Checking whether a direction applies

This is the part that catches people.

A local authority can make an Article 4 direction removing specified permitted development rights across a defined area. Where one applies to rooflights, permission is needed everywhere on the building, rear slopes included.

Article 4 directions are common in well preserved conservation areas and they are not always obvious. The council will confirm whether one applies to a specific address, and that check takes a phone call.

What an officer will be looking at

Which slope and its visibility. How far the unit projects above the finished roof surface, evidenced by the manufacturer section drawing. Whether there is a central glazing bar. And the size and number relative to the roof plane.

A low profile conservation rooflight in matt black on a rear slope, submitted with the section drawing, is the proposal most likely to succeed.

Listed is separate and stricter

A listed building needs listed building consent regardless of the conservation area position, it applies inside as well as out, and carrying out the work without it is a criminal offence.

A building can be both, and many here are.
